Mine, also 2008, was also like that except worse. Would lift up twice that much, maybe more. It wouldn't snap and stay closed either until the safety clasp was closed. Went in for an adjustment but they recommended a new clasp. Problem solved and the new clasp functions perfectly. Here's a side shot of the inner pieces properly bent.
